【案情简介】
中国银行股份有限公司某分行与辽宁某某房屋土地开发公司、沈阳某某集团保证合同纠纷案。（标的额1800万元）本所受中国银行股份有限公司委托代理该案。因某某公司欠某某集团土地转让金，中国银行提供连带责任保证。某某集团遂将某某集团及中国银行起诉至沈阳市中级人民法院。
【盛恒成果】
本案难点在于，《担保法》解释出台前，关于银行分支机构提供担保行为效力如何判断，法律无明确规定。本所律师代理该案后，及时了解了案件事实，并根据案件事实提出利于中国银行免除保证责任的观点。最终沈阳市中院采纳了本所律师的观点，判决只让中国银行承担一半的赔偿责任。一审判决下达后，某某集团不服上诉至辽宁省高级人民法院，省高院审理后同样支持了本所律师的观点，判决驳回上诉，维持原判决。本案以司法判决形式为此类纠纷确立了裁判标准。
