【案情简介】

中国银行XXX支行作为中国银行XX支行下属分支机构，于2014年7月9日与甲公司担保的乙公司签订了《流动资金借款合同》，向乙公司提供借款1000万元，同时贵行与甲公司另行签订了《保证金质押合同》，约定由甲公司将一定比例的单笔业务保证金（100万元）存入在中国银行的保证金账户，作为该笔借款的保证金质押给贵行。协议签订后，银行依约发放了1000万元贷款。被告乙公司在该笔贷款到期后未履行还款义务，保证人亦未承担保证责任，同时由于甲公司的保证金账户被其他法院查封，导致银行暂时无法扣划保证金用以偿还众立公司的欠款。

【盛恒成果】

为维护中行合法权益，中行于2016年3月31日向丙法院提起诉讼，法院对于银行主张的150万元保证金的优先受偿权的诉求，仅支持了其中100万元单笔业务保证金的优先受偿权，而对于另50万元基础保证金的优先受偿权没有支持，理由是一审法院认为银行提供的证据不足以支持该50万元基础保证金的优先受偿权。后我所律师代理中国银行提起上诉，经过我所律师的不懈努力，数次与法官“据理力争”，终于二审法院支持了中行的请求。成为中国银行在该系列案件中，其他支行在主张基础保证金优先受偿时能够获得基层法院的支持打下了坚实的基础。
