【案情简介】

借款人侯某某因欠多个债权人债务，同时又涉嫌刑事犯罪，在某某支行起诉之前，侯某某的抵押房产被秦皇岛市海港区法院查封。根据法律规定，被执行人财产由先查封法院进行处置。为了尽快实现某某支行债权，我所律师多次催促和平区法院法官与秦皇岛市海港区法院沟通，希望由和平区法院先行处置抵押房产，但海港区法院办案法官始终没给正式回复。

为此，我所律师及银行人员陪同和平区法院法官直接前往该院，与办案法官及院长协商由沈阳市和平区法院先行处置该房产，但由于该院查封房产原因是侯某某涉嫌刑事犯罪，所以该院不同意和平区法院处置。

为了保护支行的利益，我所律师并没有因此而放弃，多次申请和平区法院向秦皇岛市海港区法院及河北省高级法院正式发函，同时又几次陪同和平区法院法官前往海港区法院进行沟通。最终该院书面同意沈阳市和平区法院对本案抵押房产先进行司法拍卖。2010年11月16日，该抵押房产被依法拍卖成交，银行的债权得以全部清偿。
