2018年5月14日，中国移动某公司与广东某通信技术股份有限公司（以下称某公司）通过招标的方式签署2018-2019年网络综合代维服务合同，约定某公司为中国移动某公司在丹东、营口地区的基站设备等提供代维服务，某公司委托某某劳务有限公司营口分公司执行代维服务。李某某、李某等6人为某某劳务有限公司营口分公司员工，后期某某劳务有限公司营口分公司与6人解除劳动合同。2019年，李某某、李某等6人以某某劳务有限公司营口分公司（以下称某某劳务）、中国移动某公司为被告诉至营口市西市区法院，请求某某劳务及中国移动某公司支付解除劳动合同经济补偿金及未休年假工资，中国移动某公司承担连带给付责任，同时解除劳动合同补偿金计算年限要求将之前的工作单位年限连续计算。

西市区法院支持了李某某等6人的诉讼请求，中国移动某公司及某某劳务上诉后，营口市中级人民法院撤销原审判决、发回西市区法院重新审理，西市区法院重新审理后判决某某劳务承担6人在该公司工作期间的解除劳动合同补偿金，未判决中国移动某公司承担连带责任。6人再次上诉，营口中院维持原审判决。
李某某等6人先后与执行中国移动某公司基站设备基站设备的公司多家公司签署劳动合同，从中国移动某公司基站设备维工作，对于是否属于劳务派遣还是劳务外包以及工龄是否应连续计算存在较大争议，最终经过律师的努力，法院没有认定劳务派遣关系，对于工龄的连续计算也未予以认定。
