本所作为辽宁某新房地产开发有限公司(以下简称“某新公司”）破产管理人，未予支持沈阳某德房地产开发有限公司（以下简称“某德公司”）对某新公司九栋房产享有所有权的主张。某德司不服提起诉讼，要求确认其对九栋房产享有所有权并行使取回权。

管理人代表某新公司应诉，提出某德公司不能仅依据《合作协议》，在未经登记的情况下即取得诉争九栋房产的物权性质的权利，因为违反了物权登记原则。另外本案也不应适用《破产案件规定》第七十一条第五项之规定认定某德公司享有取回权。因为该规定是为正确适用《中华人民共和国企业破产法（试行）》所制定的司法解释，随着新《中华人民共和国企业破产法》的施行，尤其是《破产法司法解释二》第二条对不应认定为破产财产的情形，作出了不同于《破产案件规定》第七十一条的规定，所以即使《破产案件规定》尚未被明确废止的情况下，也因与新的《破产法》规定相抵触而不应再适用。最终一审法院采纳了管理人意见，驳回某德公司诉讼请求。二审法院维持原判。
