中行与某东公司签订的抵押合同第十一条约定：“主债务在本合同之外同时存在其他物的担保或保证的，不影响抵押权人在本合同项下的任何权利及其行使，抵押权人有权决定各担保权利的行使顺序，抵押人应按照本合同的约定承担担保责任，不得以存在其他担保及行使顺序等抗辩债权人”。
中行与某金设公司、某东投资集团公司、刘某某、徐某某签订的各保证合同第四条约定：“主债务在本合同之外同时存在其他物的担保或保证的，不影响抵押权人在本合同项下的任何权利及其行使，债权人有权决定各担保权利的行使顺序，保证人应按照本合同的约定承担担保责任，不得以存在其他担保及行使顺序等抗辩债权人”。
【盛恒成果】
一审法院认为本案未约定抵押、保证的实现顺序，判决中行在要先执行抵押房产，保证人在抵押房产不足清偿部分承担还款责任。
中行不服提起上诉。
二审法院认为，本案中，对上述条款的理解应为，在本抵押合同之外，如果还有其他物的担保或者保证的，中行有权决定在抵押合同项下各担保权利的行使顺序，既可以先实现抵押合同中物的抵押权，后实现担保合同中的保证权利，也可以先实现担保合同中的保证权利，后实现抵押合同中物的抵押权，也可以抵押权利和保证权利同时行使。根据上述条款，可以认定中行与东一公司签订的抵押合同，及中行与其他保证人签订的担保合同，对中行实现债权是有明确约定的，即中行有权行使抵押权利和保证权利的先后顺序。一审认定双方没有约定借款人的抵押担保和保证人的保证先后顺序，属于法律适用错误，本院予以纠正。
