2004年，刘某某开始赊购灯塔市某某有限公司水泥，销售给沈阳某商贸公司，该公司对沈阳某某公司享有债权，沈阳某某公司遂将一套房产抵给沈阳某商贸公司，该公司又抵给刘某某，刘某某抵给灯塔市某某有限公司，灯塔市某某有限公司与沈阳某某公司签订了商品房买卖合同，但未办理任何登记备案手续。2007年，中国银行某支行依照人民法院的执行裁定，取得被执行人沈阳某某公司名下前述房产经拍卖变现的价款。灯塔市某某有限公司起诉刘某某偿还水泥款，第三人中国银行某支行返还被执行房产价值的款项。
【盛恒成果】
该案经辽阳市中级人民法院四次发回重审，灯塔市人民法院五次审理，认定中国银行的过错造成房产被拍卖，判决中国银行某支行赔偿相应款项。经我所律师认真分析案情，研究法律规定，第三人认为对诉讼标的有独立请求权的，因不能归责于本人的事由未参加诉讼，当事人认为人民法院的法律文书确有错误，损害了其民事权益，应当在法定期限内向作出法律文书的人民法院提起第三人撤销权之诉，因此灯塔市某某有限公司应当另行提起诉讼，原审法院判决中国银行赔偿相应款项没有法律依据，在辽阳中院第五次审理过程中，我所律师充分阐述了事实与理由，辽阳市中级人民法院最终支持了我所律师提出的理由，依法改判，判决驳回了对中国银行的全部诉讼请求。
