丁某持有上海浦东发展银行某分行（以下简称“浦发银行”）信用卡一张，该卡已开通网银，原关联手机号为156xxxxxxxx。2015年4月26日至2015年4月28日期间共发生6笔交易，交易金额共计13812元，丁某已经按照银行规定偿还了上述款项。但是，丁某在偿还上述款项后找到浦发银行，自称该6笔交易不是其本人所为，属于信用卡被盗用，要求浦发银行返还上述款项，经与浦发银行协商未果，遂将浦发银行起诉至沈阳市沈河区人民法院。

庭审中我所律师认为：通过互联网进行交易必须准确输入动态码才能完成，而动态码是由银行委托联通公司直接向信用卡的关联手机上发送，关联手机是保存在持卡人手中。因此，浦发银行在原告信用卡被盗刷过程中不存在过错，不应承担赔偿责任。为证实上述主张，通过我所律师不懈努力，最终调取到浦发银行已向丁某的关联手机发送了动态码的证据，并提交给法院，凭借该份证据，法院最终确认浦发银行已经履行了合同义务，不存在浦发银行私自修改丁某关联手机号的情形，同时，由于丁某未能提供证据证明浦发银行在其信用卡被盗刷的过程中存在过错，最后，法院于2015年12月17日下达一审判决，驳回了丁某的全部诉讼请求。
在近期多发的信用卡被盗刷案件中，金融机构作为被告的案件大多败诉，该案经我所律师努力，受理法院严格依据“谁主张，谁举证”的原则，支持了银行的观点。
