申请执行人中国银行股份有限公司某支行与23名借款人及其共同保证人辽宁某某房地产开发有限公司（以下简称开发公司）借款合同纠纷案于2009年7月份向沈阳市沈北新区人民法院执行局立案执行。
【盛恒成果】
在执行过程中，经过我所律师调查得知对于上述借款人购买的别墅山庄的房产，借款人实际并未交纳购房款，该房屋首付款系由开发公司自己交纳，并且开发公司实际上拥有所有权。经过我所律师举证，法院最终也认可该案件的实际借款人系辽宁某某房地产开发有限公司。
在该案执行过程中，法院于2009年8月委托沈阳市北方房地产土地资产评估有限公司对某某别墅山庄房地产价值进行了评估。法院认为因上述部分抵押房产没有完全竣工，且实际的产权人与房产局登记的产权人并不一致，即使通过拍卖程序，将房产卖出，将来办理过户手续时也存在问题。此时，恰逢政府要用某某别墅山庄地块进行第十二次全运会场馆建设。在这一背景下，我所律师多次协调十二运组委会、政府、法院。最终，法院下达（2009）北新执字第1182号民事裁定书，将辽宁某某房地产开发有限公司所有的位于某某别墅山庄的28套别墅裁归中国银行股份有限公司某支行所有。之后，中国银行与政府顺利签订拆迁补偿协议，收回全部借款本金及利息。
