【案情简介】

盛恒律师在处理一起案件的过程中，依法到某派出所调查承办案件中的当事人个人信息，某派出所以“派出所没有向单位、个人提供他人信息的义务，并且只有法院有权调取公民个人信息”为由拒绝提供。上级主管部门也以律师不得调查公民个人信息为由回复律师。

盛恒律师认为某派出所拒绝协助调取律师依法查询的个人信息，严重违反了《律师法》赋予律师的的实体权利，属于不作为行为，遂向法院提起诉讼。请求法院依法判令某派出所履行法定职责，协助原告调取当事人信息。根据《律师法》第三十五条规定，法院认为在本案中，承办案件当事人的个人信息应属于调查与律师承办法律事务有关的情况，从而支持了律师的诉讼请求。
