【案情简介】

2014年6月19日，xx重工集团有限公司以受益人为“Empedocle 2 SCPA” Joint Venture向XX银行申请开立了编号为GC0486114000421的独立保函。2018年6月25日Empedocle 2 SCPA向XX银行主张索赔，2018年7月2日，XX银行就Empedocle 2 SCPA名称与独立保函中载明的受益人“Empedocle 2 SCPA” Joint Venture不一致提出了异议，因此未能付款。

之后，Empedocle 2 SCPA向XX银行连续发送两份律师函，对上述名称不一致的问题进行了解释，函中还写明要求尽快履行付款义务，否则将通过诉讼程序解决纠纷。
