2020年9月4日，德国葛博士通过盛恒法兰克福律师事务所联系了盛恒总部律师，提出自己在沈阳某大型国有集团公司担任董事长顾问已经10年，目前该国有集团公司处于重整阶段，对其提出解聘。但解聘理由有二：一、集团处于重整阶段，很多岗位不再配置；二、葛博士违反了考勤制度。事实上，葛博士有两点异议，一是其未违反考勤制度，二是解除劳动协议书，但该集团公司应按照劳动协议书约定进行赔偿。

经过盛恒总部律师和德国律师、当事人葛博士沟通了解，葛博士认为德国相关法律法规其签署的劳动协议书有效，故发生解聘协议书时，集团应该按照约定赔偿。但根据我国法律规定，劳动纠纷应按照《劳动合同法》及相关规定处理，故盛恒总部律师向葛博士解释了依照中国法律规定，约定赔偿金额已经超出法定上限，一旦仲裁和诉讼无法达到客户逾期，反而和公司私下和解比较有利。
